THE “OUTSOURCED” HOLIDAY IN GOA SWEEPSTAKES
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
1. Eligibility: The “OUTSOURCED” HOLIDAY IN GOA SWEEPSTAKES (the “Sweepstakes”) is sponsored by India Film Investors Two, LLC (the “Sponsor”). The Sweepstakes is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years old at the time of entry. The cast, crew and service providers on the motion picture “Outsourced,” active employees and agents of ShadowCatcher Entertainment, LLC, India Film Investors, LLC and India Film Investors Two, LLC , and all of their respective affiliates, subsidiaries and suppliers, advertising and promotion agencies, and legal and business advisors and the immediate family (spouse, parents, siblings and children and their respective spouses, regardless of where they reside) and household members of each such person, whether or not related are not eligible. Participation is subject to all applicable federal, state, and local laws and regulations. Void where prohibited by law. Participation constitutes entrant’s full and unconditional agreement to these Official Rules. Sponsors decisions are final and binding in all matters related to the Sweepstakes. Winning the prize is contingent upon fulfilling all requirements set forth herein.
2. Sponsor: India Film Investors Two, LLC, a Washington limited liability company located at 4701 SW Admiral Way Box 32, Seattle WA 98116.
3. Timing: The Sweepstakes begins on May 1, 2008 at 12:00 a.m. Eastern Time ("PT") and ends on September 1, 2008 at 11:59 a.m. PT (the "Sweepstakes Period"). Sponsor’s computer is the official time keeping device for this Sweepstakes.
4. How to Enter: Automatic entry, if otherwise eligible, to purchasers of the Special Preview Edition of the “Outsourced” DVD. Free Method of Entry: If otherwise eligible, on a 3 x 5 card hand print your name, address, phone number and the words “Holiday in Goa Sweepstakes” and mail it in a standard #10 envelope with first class postage to: Sweepstakes, India Film Investors Two LLC, 4701 SW Admiral Way Box 32, Seattle WA 98116. Limit one entry per person or household. Use of any automated system to participate is prohibited and will result in disqualification and all associated entries will be void. Released Parties (as defined below) are not responsible for lost, late, incomplete, invalid, unintelligible or misdirected registrations, entries, transactions, plays or travel information, all of which will be disqualified.
5. Sweepstakes: The Sponsor’s decisions as to the administration and operation of the Sweepstakes and the selection of the winner are final and binding in all matters related to the Sweepstakes. The Sponsor will randomly select the Sweepstakes winner from all eligible entries received during the Sweepstakes Period on or about September 15, 2008.
6. SELECTION OF THE WINNER IS SUBJECT TO VERIFICATION OF ELIGIBILITY AND COMPLIANCE WITH THE TERMS OF THESE OFFICIAL RULES BY SPONSOR, WHOSE DECISION IS FINAL AND BINDING IN ALL MATTERS RELATED TO THE SWEEPSTAKES. AN ENTRANT IS NOT A WINNER UNLESS AND UNTIL ENTRANT’S ELIGIBILITY AND COMPLIANCE WITH THE TERMS OF THESE OFFICIAL RULES HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE.
7. Verification of Potential Winner: The potential winner must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling the requirements expressed herein. The potential Sweepstakes winners will be notified by email, telephone, or registered mail after the date of the random drawing. Except where prohibited, the potential winners must execute and return, within ten (10) days of the date of being notified, an Affidavit of Eligibility, Liability & Publicity Release (unless prohibited by law) (“Affidavit”) if a U.S. resident in order to claim his/her prize. If a prize or prize notification is returned as undeliverable, if a potential winner of any prize cannot be contacted within a reasonable time period, fails to execute and return all required documents within the required time period, or does not otherwise comply with these Official Rules, he/she will be disqualified. In the event that the potential winner is disqualified for any reason, Sponsor may award the applicable prize to an alternate potential winner by random drawing from among all remaining eligible entries.
8. Prize: TWO (2) ROUND TRIP AIRLINE TICKETS ON A COMMERCIAL AIRLINE FROM A NYC AREA AIRPORT OR SELECTED WEST COAST CITY AIRPORT TO GOA AIRPORT IN PANAJI, GOA; HOTEL TRANSFERS; AND 4 NIGHTS LODGING (ONE ROOM) AT A LUXURY HOTEL IN GOA. Travel services arranged by Just Fares (www.justfares.com). Approximate Retail Value: $6000 USD. Actual value may vary based on airfare and hotel pricing fluctuations. Winner will not receive difference between any actual and approximate retail value. Winner must book travel at least THIRTY DAYS (30) days in advance. Travel must be completed by 4/30/09. Travelers must have valid passports. Terms and conditions and blackout dates apply to travel dates. Travel blackout dates: November 20, 2008 – February 5, 2009. Blackout dates subject to change. Travel is subject to applicable contract of carriage of the airlines used. Odds of winning a Sweepstakes prize depend on the number of eligible entries received during the Sweepstakes Period. Limit: One (1) Sweepstakes prize per person and per household. Prize may not be exchanged for its cash equivalent. All prizes are non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize for one of equal or greater value if the designated prize should become unavailable for any reason, in its sole discretion. Winner is responsible for all federal, state and local taxes (including income and withholding taxes), transportation to/from US international departure/arrival city and all costs and fees associated with prize receipt and/or use not specified herein as being provided.
9. Release: By participating in the Sweepstakes, participant agrees to release and hold harmless ShadowCatcher Entertainment, LLC, India Film Investors, LLC and India Film Investors Two, and all of their respective parents, subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies and all of their respective officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Sweepstakes or receipt or use or misuse of the prize (including any injury or harm resulting from any travel or activity associated with any prize or the Sweepstakes).
10. Publicity: Except where prohibited, participation in the Sweepstakes constitutes each winner’s consent to Sponsor’s and their designees’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for advertising, promotional and other purposes in any and all media, now or hereafter devised worldwide, in perpetuity without further payment or consideration, notification or permission.
11. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Sweepstakes. In the event of termination, Sponsor may, in its sole discretion, award the Sweepstakes prize from among all eligible, non-suspect Sweepstakes entries received up to time of such action. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner and void all associated entries/plays. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
12. Limitations of Liability: Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing, typographical or other errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) computer, mechanical technical, printing, typographical or human or other errors which may occur in connection with the administration of the Sweepstakes or the processing of entries, (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of the prize (including any injury or harm resulting from any travel or activity associated thereto). If for any reason an entrant's eligible entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes. If the promotion has been terminated, Sponsor in its sole discretion may elect to hold a random drawing from among all eligible entries, including those eligible entries confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, received up to the date of discontinuance for any or all of the prizes offered herein. No more than one prize herein will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than one prize winner to be selected, Sponsor reserves the right to award the prize by a random drawing among all legitimate, eligible entries selected.
13. Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Western District of Washington or the appropriate Washington State Court located in Seattle, Washington; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, and in no event shall entrant be entitled to obtain attorneys’ fees or other legal costs; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Washington, without giving effect to any choice of law or conflict of law rules (whether of the State of Washington or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Washington.
14. Entrant's Personal Information: Information collected from entrants will not be made available, sold, or made available to third parties except and only to administer the Sweepstakes (except that the winner agrees to the Publicity provisions set in paragraph 10 above).
15. Winner Identification: For name of the winner (available four weeks after closing date), send a request with a stamped self addressed envelope to Sweepstakes Winner Request, India Film Investors Two, LLC, 4701 SW Admiral Way Box 32, Seattle WA 98116. Request must be received by December 31, 2008.
